By downloading, installing, or using the Spinion mobile application ("App", "Service", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Spinion is a mobile application that helps users discover restaurants through:

• Location-based restaurant search powered by Yelp Fusion API
• Interactive "spin the wheel" feature for random restaurant selection
• Search filters and customization options
• Spin history tracking

• You must be at least 13 years old to use this App
• By using the App, you represent that you meet this age requirement
• If you are under 18, you must have permission from a parent or guardian

4.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

4.2 Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the Service
• Upload viruses or malicious code

5.1 Third-Party Data

• Restaurant information is provided by Yelp Fusion API
• We do not own or control this data
• Data accuracy and availability are subject to Yelp's terms and policies

5.2 Yelp Attribution

• Restaurant data is provided "as is" from Yelp
• The Yelp logo and trademarks are property of Yelp Inc.

5.3 No Endorsement

• We do not endorse any restaurant or business listed in the App
• Restaurant ratings and reviews are from Yelp users, not our own
• We are not responsible for the quality, safety, or accuracy of listed restaurants

You agree to use the App in compliance with:

• All applicable local, state, national, and international laws
• These Terms of Service
• Our Privacy Policy

Prohibited Uses:

• Harassing, abusing, or harming others
• Impersonating any person or entity
• Collecting data from the App without permission
• Using the App to spam or phish
• Violating intellectual property rights

7.1 Location Permission

• The App requires location access to find nearby restaurants
• You can grant or deny location permission at any time
• Denying location will limit functionality but the App will still work with manual search

7.2 Location Accuracy

• We use GPS, Wi-Fi, and network-based location services
• Location accuracy depends on your device and environment
• We are not responsible for inaccurate location results

8.1 Ad-Supported Service

• The free version of the App is supported by advertising
• Ads are provided by Google AdMob
• You may see third-party advertisements

8.2 Ad Content

• We do not control or endorse ad content
• Clicking ads may redirect you to third-party websites
• Third-party advertisers have their own privacy policies

9.1 Premium Features

• We may offer in-app purchases for premium features (e.g., ad-free experience)
• Purchases are processed through Apple App Store or Google Play Store
• Refunds are subject to App Store/Play Store policies

9.2 Pricing

• Prices are displayed in your local currency
• Prices are subject to change without notice
• You are responsible for any applicable taxes

10.1 Our Rights

• The App, including its design, code, graphics, and user interface, is owned by us
• Our trademarks, logos, and brand names are protected
• All rights not expressly granted are reserved

10.2 User Content

• If you submit feedback, suggestions, or ideas, you grant us the right to use them without compensation
• We do not claim ownership of your personal data (see Privacy Policy)

10.3 Third-Party Rights

• Yelp data and trademarks belong to Yelp Inc.
• Google services (Maps, AdMob, Firebase) belong to Google LLC
• Third-party libraries and dependencies have their own licenses

11.1 "AS IS" Service

11.2 Restaurant Information

• We do not guarantee the accuracy of restaurant data
• Restaurants may change hours, menus, prices, or close without notice
• We are not responsible for your experiences at restaurants found through the App

11.3 Limitation of Liability

11.4 Exceptions

Some jurisdictions do not allow limitations on warranties or liability. In such cases, the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Spinion, its owners, employees, and affiliates from:

• Any claims arising from your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

14.1 By You

You may stop using the App at any time by uninstalling it.

14.2 By Us

We may suspend or terminate your access to the App if:

• You violate these Terms
• You engage in illegal or harmful behavior
• We discontinue the Service
• Required by law

14.3 Effect of Termination

• Your license to use the App ends immediately
• You must delete the App from all devices
• Certain provisions (disclaimers, liability, indemnification) survive termination

• We reserve the right to modify these Terms at any time
• Changes will be posted with an updated "Last Updated" date
• Continued use after changes constitutes acceptance
• Material changes will be notified via in-app notification

16.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

16.2 Dispute Resolution

Arbitration:

• Any disputes shall be resolved through binding arbitration
• Arbitration shall be conducted by the American Arbitration Association (AAA)
• You waive the right to participate in class actions
• Arbitration will be conducted in California or remotely

16.3 Exceptions

• Claims for injunctive relief may be brought in court
• Small claims court disputes are exempt from arbitration

17.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 Waiver

Failure to enforce any right does not waive that right.

17.4 Assignment

You may not assign these Terms. We may assign them without restriction.

17.5 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, strikes).

• These Terms are between you and us, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any product liability claims

If you downloaded the App from Google Play:

• These Terms are between you and us, not Google
• Google has no obligations or liabilities under these Terms
• Google is a third-party beneficiary of these Terms
